Terms of Service

Welcome to Klimate

These Terms of Service ("Terms") govern your use of the Klimate app, the tryklimate.com website, the Element AI features, and the Klimate Drops product line, all operated by Klimate LLC, a Missouri limited liability company ("Klimate," "we," "us"). By creating an account, joining the waitlist, or using any part of Klimate, you agree to these Terms.

Important — Please readKlimate is a skincare guidance and personal care platform. It is not a medical service, and Element AI is not a doctor or dermatologist. See the "Not medical advice" section below.

Who can use Klimate

You must be at least 13 years old to use Klimate. If you are between 13 and 18, you must have a parent or guardian's permission. By using Klimate, you confirm you meet these requirements.

Your account

You are responsible for keeping your password secure and for everything that happens under your account
One account per person — please do not share accounts
If you sign in with Apple, your Apple credentials govern that login flow
You must provide accurate information and keep it current

Subscription and pricing

Klimate Pro — $6.99/month

Klimate Pro is our standard subscription. It includes full Element AI features, daily protocols, the skin diary, and (when launched) 20% off all Klimate Drops orders. Subscriptions auto-renew monthly until canceled.

Founding 100

The first 100 paying subscribers receive lifetime founder pricing. As long as your subscription remains continuously active and in good standing, your monthly rate will not increase, even when standard pricing changes. If you cancel and later resubscribe, the founder rate is forfeited and you will be charged the then-current standard rate. Founder pricing is non-transferable.

Billing

App subscriptions are billed by Apple through your App Store account; web subscriptions are billed by Stripe
Charges renew automatically until you cancel
You can cancel anytime in your App Store settings (iOS) or your Klimate web account
Refunds are governed by Apple's App Store policies for iOS purchases and by Klimate's discretion for direct web purchases

Klimate Drops (when launched)

Klimate Drops are physical skincare products that ship separately from your subscription. When Drops launch:

Drops orders are billed and shipped separately from your Klimate Pro subscription
Klimate Pro members receive 20% off Drops
Returns and exchanges will be governed by a separate Drops Return Policy posted on this site before launch
All formulations are plant-based and intended for cosmetic use only

Not medical advice

Esthetician disclaimerKlimate is operated by a licensed esthetician (State of Missouri) and is intended for cosmetic skincare guidance only. Element AI is not a physician, dermatologist, or medical professional. The protocols, scores, and recommendations Klimate generates are not medical diagnoses, treatments, or substitutes for professional medical care.

If you have a skin condition, allergy, sensitivity, or any health concern, consult a licensed dermatologist or physician before using Klimate's recommendations or any Klimate Drops product. Stop using any product immediately and seek medical attention if you experience irritation, allergic reaction, or any adverse effect. You are responsible for patch-testing new products and for knowing your own sensitivities.

Acceptable use

You agree not to:

Use Klimate for any unlawful purpose
Reverse-engineer, scrape, or attempt to extract Element AI's models or training data
Resell, sublicense, or commercially exploit Klimate without our written permission
Upload content that is harmful, offensive, infringing, or violates anyone's privacy
Interfere with the security or operation of the platform
Create accounts using automated means or false information

Your content

You retain ownership of the content you create in Klimate (skin diary entries, photos, notes). By using Klimate, you grant us a limited license to store, process, and display that content solely to operate the service for you. We do not claim ownership of your skin photos or diary entries, and we do not use them for any purpose other than providing Klimate's features to you, subject to the Privacy Policy.

Intellectual property

Klimate, the Klimate name, the Element AI name, the Klimate Drops product names (Shield, Surge, Radiance, Fortify, Glow), the Klimate logo, the tagline "Your Skin, in its Element," and all related marks, designs, and content are owned by Klimate LLC. You may not use them without our written permission.

Termination

You can stop using Klimate and delete your account at any time. We may suspend or terminate your account if you violate these Terms, abuse the service, or for legal reasons. If we terminate your account without cause, we will refund any unused portion of a prepaid subscription period.

Disclaimers

Klimate is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that Element's recommendations will produce any particular skincare outcome. Climate data is provided by third parties and may be inaccurate or delayed.

Limitation of liability

To the maximum extent permitted by law, Klimate LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of Klimate. Our total liability for any claim related to Klimate will not exceed the greater of $100 or the amount you paid Klimate in the 12 months before the claim arose.

Indemnification

You agree to indemnify and hold harmless Klimate LLC from any claims, damages, or expenses arising out of your misuse of the service, your violation of these Terms, or your violation of any third party's rights.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles. Any dispute arising out of or relating to Klimate or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in St. Louis County, Missouri. You and Klimate waive the right to a jury trial and the right to participate in a class action. If arbitration is unavailable, disputes will be brought in the state or federal courts located in St. Louis County, Missouri.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app at least 14 days before the changes take effect. Continued use of Klimate after the effective date means you accept the updated Terms.
